NAMASTE A MERMAID'S OASIS

TERMS OF SERVICE, ASSUMPTION OF RISK, LIABILITY WAIVER, MEDIA RELEASE, AND BOOKING POLICY

By booking, purchasing, registering for, attending, participating in, or receiving any service offered by Namaste A Mermaid's Oasis, Heather Wiles, its instructors, contractors, volunteers, affiliates, venue partners, sponsors, hosts, employees, agents, and representatives ("Namaste A Mermaid's Oasis"), you acknowledge that you have read, understood, and voluntarily agree to the following Terms and Conditions.

ASSUMPTION OF RISK

Participation in yoga, beach yoga, paddleboard yoga, surfing instruction, paddleboarding, meditation, breathwork, sound healing, sound baths, wellness experiences, retreats, fitness activities, outdoor recreation, water activities, private sessions, group events, and related services involves inherent risks that cannot be completely eliminated.

These risks may include, but are not limited to:

• Slips, trips, falls, and collisions
• Muscle strains, sprains, fractures, and physical injuries
• Drowning and water-related incidents
• Sun exposure, dehydration, heat exhaustion, and heat stroke
• Encounters with wildlife, insects, marine life, and environmental hazards
• Weather-related conditions and natural events
• Equipment malfunction or failure
• Aggravation of pre-existing medical conditions
• Emotional or psychological responses during wellness activities
• Actions of other participants or third parties

You voluntarily choose to participate and expressly assume all known and unknown risks associated with participation.

HEALTH ACKNOWLEDGMENT

You affirm that you are physically, mentally, and emotionally capable of participating in the services you select.

You understand that Namaste A Mermaid's Oasis does not provide medical care, medical advice, diagnosis, treatment, counseling, psychotherapy, healthcare services, or medical supervision.

You acknowledge that yoga, meditation, breathwork, sound healing, chakra balancing, energy work, intuitive guidance, and related wellness services are intended solely for educational, spiritual, recreational, relaxation, and personal development purposes.

These services are not intended to diagnose, treat, cure, or prevent any disease, injury, medical condition, or mental health condition.

If you are pregnant, have epilepsy, cardiovascular concerns, mobility limitations, recent injuries, medical conditions, or any health concerns, you are responsible for consulting an appropriate healthcare professional before participating.

RELEASE OF LIABILITY

To the fullest extent permitted by law, you release, waive, discharge, and hold harmless Namaste A Mermaid's Oasis, Heather Wiles, instructors, contractors, volunteers, venue owners, sponsors, affiliates, employees, agents, successors, and assigns from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, expenses, attorney's fees, injuries, illnesses, death, property damage, or other losses arising out of or relating to participation in any service, class, lesson, retreat, event, consultation, workshop, or program.

You understand and agree that participation is entirely voluntary and undertaken at your own risk.

Nothing in these Terms shall be interpreted to waive rights that cannot legally be waived under applicable law.

HOLD HARMLESS AND INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Namaste A Mermaid's Oasis, Heather Wiles, instructors, contractors, volunteers, venue owners, sponsors, affiliates, employees, and representatives from any claims, liabilities, damages, losses, costs, expenses, or attorney's fees arising from:

• Your participation in services or activities
• Your actions or omissions
• Damage caused by you to persons or property
• Claims brought by third parties arising from your participation

WATER ACTIVITY ACKNOWLEDGMENT

Participants engaging in paddleboard yoga, surfing instruction, paddleboarding, ocean activities, or any water-based experiences acknowledge that water recreation carries elevated risks, including serious injury, drowning, permanent disability, or death.

Participants are solely responsible for assessing their own swimming ability, comfort level, and physical readiness prior to participation.

Participation in water activities is entirely voluntary and undertaken at the participant's own risk.

MEDIA RELEASE

By attending any class, session, lesson, retreat, workshop, event, or service, you grant Namaste A Mermaid's Oasis permission to photograph, film, record, livestream, and otherwise capture your image, likeness, voice, appearance, participation, and testimonial.

You grant Namaste A Mermaid's Oasis a perpetual, worldwide, irrevocable, royalty-free license to use such content for advertising, marketing, promotional materials, websites, social media, print materials, educational content, public relations, and other lawful business purposes.

You waive any right to compensation, royalties, inspection, approval, ownership interest, or claims arising from the use of such media.

If you prefer not to appear in photographs or videos, you must notify Namaste A Mermaid's Oasis in writing before participating. While reasonable efforts may be made to accommodate such requests, complete exclusion from incidental photography, videography, or event recordings cannot be guaranteed.

NON-REFUNDABLE PAYMENT POLICY

All purchases, bookings, registrations, memberships, packages, private sessions, workshops, retreats, events, deposits, and services are final and non-refundable.

No refunds shall be issued for:

• Missed classes or appointments
• Late arrivals
• Schedule conflicts
• Travel interruptions
• Personal circumstances
• Medical issues
• Weather conditions
• Change of mind
• Failure to attend
• Dissatisfaction after participation

CREDITS, TRANSFERS, AND RAIN CHECKS

At the sole and absolute discretion of Namaste A Mermaid's Oasis, account credits, transfers, rescheduling opportunities, make-up sessions, or rain checks may be offered.

Credits, transfers, rescheduling opportunities, and rain checks are not guaranteed and remain entirely discretionary.

Any credit issued:

• Has no cash value
• Is non-refundable
• May not be redeemed for cash
• May be subject to expiration
• May be revoked in cases of abuse, misuse, or policy violations

The issuance of a credit, transfer, or rain check on one occasion does not create any obligation to provide similar accommodations in the future.

WEATHER POLICY

Outdoor activities are subject to changing weather, surf, ocean, environmental, and safety conditions.

Namaste A Mermaid's Oasis reserves the right to modify, relocate, postpone, reschedule, shorten, suspend, or cancel services, events, classes, or activities due to weather, safety concerns, environmental conditions, instructor availability, venue limitations, governmental restrictions, emergencies, or circumstances beyond our control. Alternative accommodations may be offered solely at our discretion.

RIGHT TO REFUSE SERVICE

Namaste A Mermaid's Oasis reserves the right to refuse service, deny participation, remove participants, cancel bookings, or terminate services at any time for reasons including but not limited to:

• Safety concerns
• Intoxication or impairment
• Disruptive conduct
• Harassment or inappropriate behavior
• Failure to follow instructions
• Conduct deemed contrary to the safety, integrity, mission, or values of Namaste A Mermaid's Oasis

No refund shall be required in such circumstances.

NO GUARANTEE OF RESULTS

Individual experiences and outcomes vary. Namaste A Mermaid's Oasis makes no representations, warranties, or guarantees regarding physical, emotional, mental, spiritual, financial, personal, or health-related outcomes arising from participation in any service.

THIRD-PARTY VENUES

Services may be conducted at beaches, parks, private residences, resorts, hotels, restaurants, businesses, marinas, waterfront properties, public spaces, or other third-party venues.

Participants acknowledge that Namaste A Mermaid's Oasis does not own or control all locations where services may occur and assumes no responsibility for conditions existing at third-party locations.

GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the State of Florida. Should any provision of these Terms be determined unenforceable, the remaining provisions shall remain in full force and effect.

ACCEPTANCE OF TERMS

By booking, purchasing, registering for, attending, participating in, or receiving services from Namaste A Mermaid's Oasis, you acknowledge that you have read these Terms in their entirety, understand them, voluntarily accept all risks associated with participation, agree to be legally bound by them, consent to the media release provisions, and agree to all booking, cancellation, payment, and participation policies contained herein. If you do not agree to these Terms, do not purchase, book, attend, participate in, or receive services from Namaste A Mermaid's Oasis.
